Terms of Service

1. Acceptance of Terms

By accessing or using the FDFares platform, including the website, Partner Portal, or API (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. These terms apply to all partners, agents, and users of the FDFares platform operated by Travel Hypes.

2. Partner Eligibility

To become a FDFares partner, you must:

• Be a registered business entity in India or operate a legitimate travel agency
• Provide accurate and complete information in your partner application
• Comply with all applicable Indian laws and travel industry regulations
• Not be subject to any legal prohibition from conducting travel business

3. API Usage

Partners granted API access may use the FDFares API solely for legitimate travel booking purposes. You agree not to:

• Share API keys with unauthorized third parties
• Use the API for data scraping, competitive intelligence, or spam
• Attempt to reverse-engineer or misuse the API
• Exceed documented rate limits or circumvent usage controls
• Use the sandbox environment for live customer bookings

4. Booking Responsibility

Partners are responsible for the accuracy of all bookings made through their API integration. FDFares acts as a technology intermediary. Any disputes between partners and end customers regarding bookings are the responsibility of the partner. Partners must maintain adequate complaint handling processes.

5. Payment Terms

FDFares operates on a pre-paid wallet model. Partners must maintain a positive balance to make bookings. FDFares reserves the right to suspend API access if the wallet balance falls below required thresholds. All pricing is exclusive of applicable taxes.

6. Service Availability

FDFares targets 99.97% API uptime. Planned maintenance will be communicated in advance. FDFares is not liable for service interruptions beyond its reasonable control including third-party provider outages, force majeure events, or infrastructure failures.

7. Intellectual Property

The FDFares platform, API, documentation, and all related materials are the intellectual property of Travel Hypes. Partners receive a limited, non-exclusive, non-transferable license to use the API for the purposes described in these terms. No other rights are granted.

8. Termination

Either party may terminate the partnership with 30 days written notice. FDFares may suspend or terminate access immediately for breach of these terms, suspected fraud, or regulatory compliance reasons. Upon termination, outstanding wallet balances will be refunded per the refund policy.

9. Limitation of Liability

FDFares' liability to any partner is limited to the amounts paid by that partner in the preceding 3 months. FDFares is not liable for indirect, consequential, or punitive damages arising from use of the platform.

10. Governing Law

These terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of courts in Meerut, Uttar Pradesh.
